1. Scope and Acceptance

These Terms of Use (“Terms”) govern access to and use of the Data Driven 9 Consulting LLC business assessment and management platform (the “Platform”), including all questionnaires, surveys, diagnostic methodologies, management tools, financial integrations, reports, AI-generated outputs, analytics, and related services.

The Platform includes, without limitation, management and operational tools such as Voice of the Customer (VoC), 5-Why analysis, SIPOC, process mapping, priority matrices, OKR frameworks, financial analysis modules, and benchmarking systems.

By accessing, registering for, connecting third-party systems to, completing, or submitting information through the Platform, you (“Participant,” “User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and all incorporated policies referenced below.

These Terms also apply to your interactions with DD9 via any related online properties that collect contact details or enable communications about the Platform, including (without limitation) our website pages, landing pages, booking pages, lead-capture pages, and contact forms (collectively, “Forms”). Where you provide a mobile phone number via Forms, additional SMS/MMS terms in Section 5.3 apply.

If you do not agree to these Terms, you must not access or use the Platform.

2. Incorporated Policies and Related Documents

The following documents are incorporated by reference into these Terms and form part of the binding agreement between you and Data Driven 9 Consulting LLC:

By using the Platform, you agree to comply with all applicable incorporated policies. In the event of a conflict between these Terms and any incorporated policy, the Order of Precedence section below shall apply.

3. Purpose and Intended Use

The Platform is designed solely to:

  • Collect information related to organizational operations, performance, processes, quality, people, sales, marketing, and financial practices
  • Generate analytical insights, benchmarks, summaries, AI-generated reports, and improvement recommendations
  • Provide financial analysis through authorized integrations (including QuickBooks)
  • Support business, operational, and strategic decision-making

The Platform is not intended for personal, consumer, or household use, nor for employment evaluation, hiring, promotion, compensation, or disciplinary decisions.

4. Financial Data Integration (QuickBooks and Similar Services)

The Platform may allow you to connect third-party accounting systems, including QuickBooks, for the purpose of generating financial analyses and reports.

  • You authorize Data Driven 9 Consulting LLC to access relevant financial data solely for analytical and reporting purposes.
  • Financial data is used to generate summaries, performance insights, and structured financial reports.
  • Data Driven 9 Consulting LLC does not store raw financial transaction-level accounting records beyond what is reasonably necessary to generate reports.
  • Financial data is not sold and is not used for unrelated purposes.
  • You are responsible for ensuring you have proper authorization to connect and share such financial data.

5. AI-Generated Reports and Analytics

The Platform may use artificial intelligence and automated analytical systems to generate executive summaries, diagnostic findings, financial insights, benchmarks, and strategic recommendations.

  • AI-generated outputs are based on data you provide or authorize.
  • Outputs are analytical in nature and may not reflect full business context.
  • Reports are provided for informational and strategic planning purposes only.
  • You remain responsible for validating decisions based on Platform outputs.

6. Data Collection, Processing, and Aggregation

6.1 Consent to Analytical Processing

By registering for, using, or connecting financial systems to the Platform, you expressly consent to:

  • The collection and processing of organizational and operational data
  • The analytical use of such data to generate reports and insights
  • The temporary processing of financial data for reporting purposes
  • The use of anonymized and aggregated data for benchmarking and model improvement

6.2 Data Types Collected

The Platform may collect:

  • Contact information (name, email, role, department)
  • Organizational attributes (industry, company size, geography)
  • Operational and management responses
  • Financial summary data via authorized integrations
  • Technical metadata necessary to operate the Platform

6.3 SMS/MMS Messaging Terms (A2P 10DLC) for Landing Pages and Contact Forms

Overview. If you provide a mobile phone number to DD9 through the Platform or a Form, you may opt in to receive SMS and/or MMS messages (“Text Messages”) from Data Driven 9 Consulting LLC.

Types of messages. Messages may include operational notifications (e.g., reminders, scheduling updates) and, if separately opted in, promotional communications.

Message frequency; rates may apply. Message frequency varies. Message and data rates may apply.

Consent is not a condition of purchase. Your consent to receive Text Messages is not a condition of purchasing goods or services.

Opt-out and help. You may opt out at any time by replying STOP. For help, reply HELP.

Example opt-in disclosure:

“I consent to receive SMS/MMS messages from Data Driven 9 Consulting LLC. Message frequency varies. Message & data rates may apply. Reply HELP for help and STOP to unsubscribe. By opting in, you agree to our Privacy Notice and Terms.”

7. No Professional Advice Disclaimer

The Platform and any outputs, including financial analyses and AI-generated reports:

  • Do not constitute legal, financial, tax, accounting, or regulatory advice
  • Are provided for informational and strategic planning purposes only
  • Should not replace advice from qualified professionals

Data Driven 9 Consulting LLC makes no guarantees regarding specific financial or operational outcomes.

8. Data Security and Retention

Data Driven 9 Consulting LLC implements reasonable administrative, technical, and organizational safeguards.

No system can be guaranteed 100% secure. Financial data accessed via integrations is not retained as raw accounting records beyond what is reasonably necessary to generate reports.

9. Intellectual Property Rights

All Platform content, methodologies (including VoC, 5-Why structures, scoring models, and analytical frameworks), analytics engines, AI prompt structures, and report formats are the exclusive intellectual property of Data Driven 9 Consulting LLC.

You are granted a limited, non-exclusive, non-transferable license to use outputs internally for business improvement purposes.

10. Prohibited Automated Access and Security Protections

You may not access or use the Platform through automated means except as expressly authorized in writing by Data Driven 9 Consulting LLC.

Without limitation, you agree not to:

  • Use bots, scrapers, crawlers, spiders, data mining tools, or automated scripts to access, extract, copy, monitor, or collect data from the Platform;
  • Attempt to bypass authentication mechanisms or rate limits;
  • Engage in brute-force attacks, credential stuffing, vulnerability scanning, or security probing;
  • Use automated systems to create accounts or simulate user activity;
  • Interfere with or disrupt the integrity, security, or performance of the Platform.

Any unauthorized automated access or attempt to access the Platform may result in immediate suspension or termination of access and may be referred to law enforcement authorities where appropriate.

Data Driven 9 Consulting LLC reserves the right to implement technical measures, including rate limiting, IP blocking, traffic filtering, and automated detection systems, to prevent unauthorized automated access.

11. Limitation of Liability

To the fullest extent permitted by Florida law, Data Driven 9 Consulting LLC shall not be liable for indirect, incidental, consequential, or punitive damages arising from use of the Platform, financial analysis outputs, AI-generated reports, or business decisions made based on such outputs.

Total liability shall not exceed the amount paid, if any, for access to the Platform.

12. Order of Precedence

In the event of any inconsistency between these Terms and any incorporated policy:

  • The Data Processing Addendum (DPA) shall control with respect to data protection obligations;
  • The QuickBooks Integration Addendum shall control with respect to financial integrations;
  • All other matters shall be governed by these Terms of Use.

13. Governing Law and Venue

These Terms shall be governed by the laws of the State of Florida. Any disputes shall be brought exclusively in Florida state or federal courts.

14. Changes to Terms

Data Driven 9 Consulting LLC may update these Terms from time to time. Continued use constitutes acceptance of the revised Terms.
